Data protection

In the following, we provide information about the collection of personal data when using our website. Personal data is all data that can be related to you personally, e.g. name, address, e-mail addresses, user behavior.

Controller responsible for data processing

The controller pursuant to Article 4(7) of the General Data Protection Regulation (GDPR) is Future4ColombianKids, see our legal notice.

Data protection officer:‍

Linus Sluyter
Email: linus@future4colombian.kids

Collection and use of your data

The scope and nature of the collection and use of your personal data differs depending on whether you visit our website only to retrieve information or to make use of any services we may offer.

If we use other (IT) service providers for individual functions of our website or would like to use your data for advertising purposes, we will inform you in detail below about the respective processes (all data processing). We will also state the applicable legal basis for data processing.

Informational use

For the informational use of our websites, we only collect the personal data that your browser automatically transmits to us, such as

  • IP address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • the amount of data transferred and the access status (file transferred, file not found, etc.)
  • Website from which the request originates
  • Browser type / version / language
  • Operating system and its interface
  • Language and version of your browser

Legal basis for data processing:

The above-mentioned data is technically necessary to display our websites to you and to ensure stability and security, in accordance with Art. 6 para. 1 lit. f) GDPR.

Contact form

When you contact us via the contact form, the data you provide (your name, your e-mail address, your telephone number if applicable and your message) will be stored by us in order to answer your question(s). Mandatory information required for this is marked separately, further information is voluntary.

Storage period:

We delete the data arising in this context after storage is no longer required, or restrict processing if there are statutory retention obligations (max. ten years as part of the archiving of business e-mail traffic required under commercial and tax law).

Legal basis for data processing:

Processing is necessary for the performance of pre-contractual measures taken at the request of the data subject, pursuant to Art. 6 para. 1 lit. b) GDPR. In all other cases, processing is carried out on the basis of Art. 6 para. 1 lit. f) GDPR, as we have a legitimate interest in processing inquiries.

Inquiries by email

If you contact us by email, your request and the personal data contained therein will be processed by us for the purpose of processing your request by the persons authorized to do so.

Storage period:

We process and store the data until the purpose of the processing has been fulfilled and statutory retention obligations (generally 10 years retention period) do not prevent this or you have effectively objected to the processing.

Legal basis for data processing:

Your data is processed on the basis of Art. 6 para. 1 lit. b) GDPR if your request is related to the implementation of pre-contractual measures. In all other cases, the processing is carried out on the basis of Art. 6 para. 1 lit. f) GDPR, as we have a legitimate interest in processing inquiries.

Newsletter

In order to receive our newsletter regularly, we require your email address in addition to your consent under data protection law.

We generally use the so-called double opt-in procedure for registration, i.e. we will only send you the newsletter if you first confirm your registration via a confirmation e-mail sent to you for this purpose using a link contained therein. This is to ensure that only you, as the owner of the e-mail address provided, can register for the newsletter. You must confirm your subscription promptly after receiving the confirmation e-mail, otherwise your newsletter subscription will be automatically deleted.

Newsletter performance measurement:

We would like to point out that we evaluate your user behavior when sending the newsletter. For this evaluation, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files and are stored on our websites.

For the evaluations, we link the web beacons or tracking pixels with your e-mail address and an individual ID.

Revocation of performance measurement:

You can prevent such tracking if you have deactivated the display of images in your e-mail program by default. In this case, the newsletter will not be displayed in full and you may not be able to use all the functions. If you display the images manually, the above-mentioned performance measurement will take place.

Withdrawal of your consent:

You can unsubscribe from a newsletter you have subscribed to from us at any time - by clicking on the corresponding link at the end of the newsletter or by sending a message to the contact details given in the legal notice.

Contracted service providers:

Our newsletter is provided by the contracted service provider:
HubSpot, Inc, 25 First Street, 2nd Floor, Cambridge, MA 02141 USA

Storage duration:‍

After successful registration, your data will be stored for as long as you have subscribed to the newsletter. We delete your data after you unsubscribe.

In addition, we store the IP addresses you use and the times of registration and confirmation of the newsletter. The background to this is the required proof of your consent and, if necessary, the clarification of a misuse of your personal data (e.g. a third party uses your e-mail address for registration without authorization).

Legal basis for data processing:

The subscription to the newsletter is based on your personal consent, pursuant to Art. 6 para. 1 lit. a) GDPR. The storage of more detailed information, e.g. the time of your registration, is in our interest, in accordance with Art. 6 para. 1 lit. f) GDPR. The evaluation of the above-mentioned performance measurement is carried out in our interest in making the newsletter generally more interesting and better tailored to our reader group, in accordance with Art. 6 para. 1 lit. f) GDPR.

Use of cookies

We use cookies for our websites. Cookies are small text files that are sent to your browser by our web server when you visit our website and are stored on your computer for later retrieval. They are used to make the website more user-friendly and effective overall.

This website uses cookies to the following extent:

  1. Technically necessary cookies
  2. Functional cookies
  3. Third-party cookies (from third-party providers)

Cookies can basically be divided into two categories:

Transient cookies are automatically deleted when you close the browser. These include session cookies in particular. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognized when you return to the website. The session cookies are deleted when you log out or close the browser.

Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies at any time in the security settings of your browser.

Regardless of your choice in the Consent Manager, you can configure your browser settings according to your wishes and, for example, refuse to accept third-party cookies or all cookies. However, we would like to point out that you may then not be able to use all the functions of this website.

You can also find more information on how cookies can be rejected using special browser plug-ins in the introduction to the "Integrated services" section further down in our privacy policy.

Web analysis

It is important to us to design our websites as optimally as possible and thus make them attractive for our visitors. To do this, we need to know which parts of it are received by our visitors and how. We use HubSpot, a web analysis service, for this purpose. HubSpot uses cookies, which are stored on your computer and enable us to analyze the use of the website. The information generated by the cookie about your use of our websites is usually transferred to a HubSpot server in the USA and stored there.

Integrated services

To design our websites and provide additional functions, we integrate HubSpot in our own interest for our online marketing activities. HubSpot is an integrated software solution that we use to cover various aspects of our online marketing.

These include, among others

  • Customer relationship management
  • Email marketing (newsletters and automated mailings, e.g. to provide downloads)
  • Reporting (e.g. traffic sources, hits, etc. ...)
  • Contact management (e.g. user segmentation & CRM)
  • Landing pages and contact forms

Our online registration service enables visitors to our website to find out more about our products and services, download content and provide their contact information and other data. This information as well as the content of our website is stored on servers of our software partner HubSpot.

This service is provided by:

The provider is the American company HubSpot, Inc, 25 First St 2nd Floor Cambridge, MA, USA. The company also has a registered office in Ireland, 1 Sir John Rogerson's Quay, Dublin 2, Ireland. Further information on data protection at HubSpot, Inc. can be found at: https://legal.hubspot.com/de/privacy-policy

Storage period:

See Storage duration of the logs under Informational use above in this privacy policy.

Legal basis for data processing:

We use HubSpot on the basis of your consent, pursuant to Art. 6 para. 1 lit. a) GDPR.

YouTube

We have integrated YouTube videos into our websites, which are stored on https://www.youtube.com and can be played directly from our websites.

Analysis of your user behavior by YouTube (Google):

YouTube (Google) stores your data as usage profiles and uses them for the purposes of advertising, market research and/or needs-based design of its websites. Such an analysis is carried out in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our websites.

You have the right to object to the creation of these user profiles, whereby you must contact YouTube (Google) to exercise this right.

The service is provided by:

The provider is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA.

Further information on data protection at YouTube Inc. (Google Inc.) can be found at: https://www.google.de/intl/de/policies/privacy

Storage duration:

See storage duration of the logs under Informational use above in this privacy policy.

Legal basis for data processing:

We use YouTube on the basis of your consent, pursuant to Art. 6 para. 1 lit. a). For the exceptional cases in which personal data (your IP address) is transferred to the USA, YouTube (Google) relies on the European Standard Contractual Clauses:
https://policies.google.com/privacy/frameworks?hl=de

Social media links

Our websites contain links to various social media with the corresponding logos. These are not social media plug-ins, but merely a link to our offers within these media. If you click on one of these links, your IP address will always be transmitted to the operators of the various platforms. If you use one of these services and are also logged in with your specific account, information about your surfing behavior may also be recorded by the operators of the social media. The transmission of your IP address to the operators of the websites accessed is technically necessary and applies to all websites.

We can only exert limited influence on the processing of personal data by the social media platform operators. At the points of data processing by the platform operator that we can influence, we work towards data protection-compliant handling within the scope of the possibilities available to us. However, due to the limited access to data processing by the platform operators, we cannot fully identify which data they process.
The platform operator operates the entire IT infrastructure of the service and maintains its own data protection provisions. If you are a registered user of the social media service, the platform operator maintains its own user relationship with you.

In some cases, there is a relationship with the platform operators in accordance with Art. 26 para. 1 GDPR (joint responsibility).

For web tracking methods used on the social media pages, the platform operators and we act as joint controllers. Web tracking can also take place if you are not logged in or registered with the social media platform.

As mentioned, we unfortunately have little influence on the web tracking methods of the social media platform.
